As notarial activity has modernised and legal services have gone digital, administering the national notarial registers has become essential to the security of civil transactions.

To provide this IT and legal infrastructure, the National Centre for the Administration of the National Notarial Registers – INFONOT was created, the technical and operational body that manages the electronic registers of notarial activity in Romania.

A national IT system for public notaries

The National Centre for the Administration of the National Notarial Registers – INFONOT is a Romanian legal person governed by private law, under the authority of the National Union of Public Notaries of Romania (UNNPR), with its own budget, organisational structure and functional autonomy, under the conditions laid down by law and by the regulations of the notarial profession.

Its main role is to administer the national notarial registers, electronic instruments essential to the legal security of notarial documents.

The system works as a centralised digital infrastructure for managing and accessing data and records needed for notarial activity, under the law and the regulations adopted at Union level. The National Centre for the Administration of the National Notarial Registers – INFONOT operates as a specialised body within the National Union of Public Notaries of Romania, with a technical and operational role in supporting notarial activity.

Strategic decisions are coordinated at Union level, and the Centre ensures the practical implementation of the register systems.

The role of the National Centre for the Administration of the National Notarial Registers

The National Centre for the Administration of the National Notarial Registers – INFONOT acts as the digital infrastructure of the notarial system, keeping the registers running and interconnected nationally.

INFONOT exists to support the work of public notaries by making it easier to access the information needed to check legal situations relevant to authenticating documents and carrying out other notarial procedures.

The system provides mechanisms for searching and verifying data relevant to notarial activity, helping to increase the security of civil transactions and to prevent situations of legal risk.

The main functions of the National Centre for the Administration of the National Notarial Registers are:

  • Administering the national notarial registers
  • Keeping the UNNPR IT systems running
  • Drawing up the technical and methodological rules for using the registers
  • Supporting the digitalisation of notarial activity
  • Ensuring the security and traceability of notarial operations
  • Providing specialised IT services, including for a fee where the law permits

The importance of the system in notarial activity

INFONOT contributes directly to strengthening the legal security of notarial documents, by providing a single mechanism for checking information relevant to preventing errors and protecting civil transactions.

By using the system, notarial activity gains IT support that underpins the accuracy of the checks carried out during notarial procedures and reduces the risks associated with missing information or fragmented access to data.

Security and confidentiality

The operation of the INFONOT system is governed by strict rules on information security and data protection, in accordance with national legislation and the professional rules applicable to public notaries.

Access to data is limited exclusively to authorised users, and use of the system is subject to control and monitoring in accordance with the procedures established at Union level.

The registers managed through the National Centre for the Administration of the National Notarial Registers

The national notarial registers used in the daily work of public notaries operate through the National Centre for the Administration of the National Notarial Registers – INFONOT, namely:

The National Notarial Register of Gratuitous Dispositions – RNNEL

in which, since 2007, wills and/or codicils executed in authenticated form have been recorded, together with their revocation. The Register also covers testamentary dispositions concerning sums of money, valuables or securities deposited with specialised credit institutions, and their revocation. Since the new Civil Code entered into force (1 October 2011), the register has also covered gifts made by contract or by an offer of gift followed by acceptance.

The National Notarial Register of Succession Options – RNNEOS

in which, since 2007, all notarial documents accepting or renouncing an inheritance, drawn up in authenticated form, have been recorded.

The National Notarial Register of Successions with a Foreign Element – RNNES

in which, since 2007, succession cases have been recorded concerning Romanian, foreign or stateless persons whose last domicile is unknown or is not on Romanian territory and who left assets in Romania, together with the outcomes of European certificates of succession, where applicable. The database of this register is made up of information on successions settled from 1995 to date and, for the area of competence of the notaries of the Bucharest Chamber of Public Notaries, from 1954 to date.

The National Notarial Register of Powers of Attorney and their Revocation – RNNEPR

in which all powers of attorney and mandates given for the purpose of concluding documents and carrying out notarial procedures are recorded, together with any acts of express revocation. Acts revoking powers of attorney have been recorded since 2007 and, since 2013, powers of attorney bearing on notarial activity have also been registered.

The National Notarial Register of Matrimonial Regimes – RNNRM

set up when the new Civil Code entered into force (1 October 2011), this is the register in which the matrimonial regime chosen by the spouses is recorded, as mentioned in the marriage record or in the matrimonial agreement adopting or amending the regime. This register also records the documents dissolving a marriage and ending the matrimonial regime, namely divorce certificates issued through notarial and administrative channels, and court judgments granting divorce.

The National Notarial Register of Creditors of Natural Persons and of Objections to the Division of an Estate – RNNEC

in which, since 2013, creditors' applications concerning their claim against a natural person have been recorded.

The National Register of Death Records – RNEAD

which covers all death records registered from January 2012 to the present, based on the information in the death records contained in the documents sent monthly by D.E.P.A.B.D.

The National Notarial Register of Divorce Applications – RNNECD

set up in 2011, in which applications for the dissolution of a marriage by agreement of the spouses, through notarial channels, are recorded.

The National Register of Publicity of Patrimonial Estates – RNPMP

in which the documents creating professional patrimonial estates set aside for the exercise of an authorised profession are recorded, together with the legal regime applicable to them.

The National Notarial Register of Documents Transferring Property in Lieu of Payment – RNNEADP

in which, since 01.07.2016, only documents transferring property in lieu of payment based on Law no. 77/2016 on the transfer of immovable property in lieu of payment in order to discharge obligations assumed through loans are recorded.

The National Electronic Register of Protective Measures – RNEMSO

in which protective measures ordered in respect of natural persons are recorded, together with the documents and information provided by law concerning the establishment, amendment, termination or replacement of such measures. The register allows public notaries and other competent authorities to check the existence of protective measures and the relevant data concerning them, under the conditions laid down by law.

The purpose of the National Centre for the Administration of the National Notarial Registers – INFONOT

The main purpose of the National Centre for the Administration of the National Notarial Registers – INFONOT is to ensure the centralised, uniform and secure administration of the national notarial registers.

In concrete terms, the centre aims at:

  • making notarial practice uniform in the digital environment
  • increasing the security of civil transactions
  • preventing legal fraud
  • ensuring rapid access to relevant notarial information
